Niagara County, NY: (Apr-16-08) Kenneth J.S. Martin, 26, a Wilson man, brought a lawsuit against Niagara County, after he sustained injuries in a collision with a Niagara County sheriff’s patrol car in 2003. The suit claimed that Martin suffered a head injury when his all-terrain vehicle was struck by the patrol car of Deputy Matthew Cipoletti about 3 a.m. Aug. 28, 2003, on New Road in Wilson. In its defense, the Sheriff’s Office claimed that Martin was not wearing a helmet. It said that Martin slammed on the brakes and was struck by the front corner of the patrol car as Cipoletti swerved in a bid to avoid contact.

Records of the incident show that the ATV flipped over four times injuring Martin. He was admitted in Erie County Medical Center for four weeks. As a result of the injuries, he was left unable to work because of double vision, short-term memory loss and other symptoms. Court papers reveal that Wilson Town Justice George R.
