A scandal in the Spitzer administration widened Monday, with the governor admitting his office has received a new subpoena.

A source briefed on the investigation tells NY1 that Albany District Attorney David Soares started a criminal inquiry, with a grand jury in the works that could last for upwards of a year. Court proceedings could start in mid-January, right around the time the governor delivers his second State of the State address and tries to turn the page on a rough first year.

Prosecutors expect the grand jury to sift through documents, like e-mail and telephone records all pertaining to the so-called Choppergate Scandal – items that were demanded in the subpoena.

On Monday, the governor’s message wasn’t consistent. At first in Westchester County, he said he was unaware of the subpoena.

“No idea. I don’t get involved in that stuff,” he said.

But later in Albany, Spitzer said his office did receive a subpoena. The governor added that he is cooperating and grew testy when asked about the latest developments during a news conference.

“I’ve answered all these questions at length, and obviously we are cooperating fully. We take it very seriously. We wish it were getting to conclusion quickly, so we could move on. Today we are talking about higher ed, which is something that is enormously important for the future of the state,” said Spitzer. “And we just sit and wait. It is their job to do what they have to do. It is our job, and my job, to cooperate, which is exactly what I have done. I have answered all the questions over and over and I will not hesitate to answer them.”

Still, Spitzer wouldn’t reveal the contents of the subpoena.
