DA hits Gov. Spitzer’s office with new subpoena in Troopergate scandal

An angry Albany prosecutor has hit Gov. Spitzer’s office with a new Troopergate subpoena, signaling that the scandal gridlocking state government will continue into 2008.

Albany County District Attorney David Soares has ratcheted up his probe of efforts to cover up Troopergate, the botched scheme to discredit Senate Majority Leader Joe Bruno.

Within the past week, the DA has subpoenaed a slew of documents, e-mail and BlackBerry correspondence and phone records from Spitzer’s office related to the scandal, according to a source familiar with the probe.

The request was “very broad,” the source said, suggesting Spitzer could come under scrutiny.

Soares, who could convene a grand jury as early as next month to present the evidence he has amassed, issued the subpoena out of frustration with the governor’s office.

“He’s angry and he’s tired of the gamesmanship,” said the source. “He’s inclined to put the facts before a grand jury and let them sort it all out.”

This is the second Troopergate subpoena Soares has issued the Spitzer administration.

The first came when the governor’s office balked at handing over former Spitzer Communications Director Darren Dopp’s personal diary.

The evidence Soares would present to the grand jury would not be limited to an allegation of perjury committed by Dopp, the source said.

News of the latest subpoena means Spitzer - who has tried to put the scandal behind him after a turbulent first year in office that saw his poll numbers plummet - will start the new year with a cloud still over his head and the agenda that got him elected stalled into a second year.

Spitzer spokesman Errol Cockfield declined to comment on the subpoena, saying it would be “inappropriate” to do so while Soares’ probe is ongoing.
