So typical that Holt is trying to turn this into a racist issue… He is an admitted criminal, he admitted guilt, how is that racist… It’s not! He broke the Law and according to New York Public Officers Law. Section 30 of that law says every public office shall become vacant upon the officer’s conviction of a crime involving a violation of the Oath of Office, which can include knowingly giving false statements.
This Law was not invented or recently crafted to use against Holt… Compare what is going on with Holt to an actual lynching..
Lynching…?
Lynching is the illegal execution of an accused person by a mob. After the establishment of the Ku Klux Klan in 1867 the number of lynching of African American increased dramatically. The main objective of the KKK was to maintain white supremacy in the South, which they felt was under threat after their defeat in the Civil War. It has been estimated that between 1880 and 1920, an average of two African Americans a week were lynched in the United States.
About Lynching
Lynching is the practice whereby a mob–usually several dozen or several hundred persons–takes the law into its own hands in order to injure and kill a person accused of some wrongdoing. The alleged offense can range from a serious crime like theft or murder to a mere violation of local customs and sensibilities. The issue of the victim’s guilt is usually secondary, since the mob serves as prosecutor, judge, jury, and executioner. Due process yields to momentary passions and expedient objectives.
Is this a lynching? hardly and Holt is showing his racism and maybe that is exactly why the Democrat leadership was afraid to ask him to resign, he would play the race card.
This finding was a direct result of the Republicans proposed Law submitted to the Legislature last week. When the Law was sent to committee they asked for the county attorney’s advice. That is the normal process, the legality must be questioned and advice is always sought on proposed Laws. I am amazed that no one including Frank Clark’s office and Holt’s own attorney didn’t find it, they were just to busy making a deal.
Holt Vows to Fight Removal from Legislature
(Buffalo, NY, January 25, 2007) - - George Holt vows to fight his removal from the Erie County legislature because of a criminal conviction for failure to pay sales tax. Senior Correspondent Rich Newberg takes a look at how a broken law may have undone a lawmaker.
George Holt’s Buffalo attorney, Mark Mahoney, says Holt’s guilty plea of willfully making false tax statements does not warrant his removal from the Erie County legislature.
But Erie County Attorney Larry Rubin insists that it does, according to state law.
Rubin said, “Mr. Holt pleaded guilty to two misdemeanors. By operation of law, that plea is what removed him from office.”
Holt’s words to us were that “this is a political lynching. 50 years ago,” he said,” they would have hung me.”
He went on to say, “This is racially and politically motivated. It’s about a lame-duck County Attorney and a lame-duck County Executive, and about people who want to become the County Executive.”
Erie County lawmakers have restructured their committees without Holt, and have gone even a step further.
Democratic legislature chairwoman Lynn Marinelli said, “The votes he took subsequent to his January 8 plea will be stricken from the record.”

How absurd! It’s too bad they had to craft new legislation
to draw attention to the existing law.
George Holt is a liar and cheater who has attempted (more than once) to avoid paying in the tax money that he’s collected from area citizens. He steals from and lies to the very people whom he’s elected to serve. Then he comes right out with words to the effect that….he would have never made that plea deal if he knew he’d be punished with the loss of his privileged position. His “lynching” remarks take this whole matter from “sad” to “pathetic.” Hopefully, his crimes, along with the insult that he’s added to the injury, will force him to look for a real job and disappear from the public view forever. He and the former comptroller of New York State should be sharing a jail cell. They both got off way too light….what a surprise!
