You’ve got to be kidding… We finally have a court that agrees that the way Judicial candidates were picked before is wrong and unconstitutional, now Spitzer wants to give the governor power to hand pick them….?
I don’t care if it’s a Republican or a Democrat that is governor, this is just plain wrong. It’s bad enough that Judicial candidates were being picked by parties picking their pockets and who ever had the mnost money would get on the ballot, do we really think this would stop this practice? No this would make it worse. This would give one man the power, what an assinine idea.
Faso is right, this proves to me that Spitzer is all about power, control and simply want to deny the voters the right to vote for our own candidates for Judges.
If people want to fix the judicial process then we have to allow open primaries away from Party politics.
Faso says Spitzer’s judicial proposal bad idea
SYRACUSE, N.Y. — Democrat Eliot Spitzer’s plan to abolish judicial elections and give the governor power to appoint the state’s trial judges shows he is “power hungry” and wants to deny voters the chance to choose their own jurists, Republican gubernatorial candidate John Faso said Wednesday.
For years, state Supreme Court justices have been nominated at conventions controlled by party bosses. Last month, a federal appeals court upheld an earlier ruling that declared the method unconstitutional and that ordered the state to elect judges through more open primaries.
Spitzer, who is running for governor, on Wednesday told the New York Daily News that a better way to select state justices would be to have them appointed by the governor, sparing judges from having to campaign for office.
“Look, we all know this is the last vestige of real patronage in the political party structure,” he told the newspaper. “What I want is merit selection.”
He said if he’s elected, he’ll push for a constitutional amendment eliminating judicial elections.

Follow-up comment rss or Leave a TrackbackThat system seems to work well for the President of the United States…he appoints all the Federal Judges. If it is ok for the United States government, why would it be wrong for New York State?
Because the state of NY cannot govern itself.
Your gonna tell me that stealing out of the pockets of Judicial candidates will stop if the governor appoints them?
This will make it even worse. You just want to do this because you are so positive a Democrat will control the governors office.
Let the people vote in a primary for the judges. That is the best way, stop trying to take issues out of the people hands.
No Judicial appointments period.
Install recall system for all Judicial seats.
No lifetime Judicial opportunities.
Mandatory retirement age to be voted on.
Do you really think that the federal government is being much more well run than NYS?
ABSOLUTELY NOT.. The federal government is a mess and is so over bloated and top heavy I expect it to flip over topside anytime.
The thing about the President appointing Judges. He may appoint them but Congress has to approve them. They have to go through the vetting process, if Spitzer has his way he will just be able to appoint them without any vetting? NO, no way.
So would you support the State Senate approving a Governer-appointed Judge?
No, absolutely not.
Leave them to running in open primaries with no party endorsements.
Judges run locally with out being political, they run on their record.
It doesn’t make sense to appoint state supreme court judges using a convention system while electing the lower courts. Pick one system or the other, preferably primaries.
How the Federal Government is run is not the issue. The issue is how the judiciary is selected. How can one be objective if they know they have to run for reelection? How can one be objective if they have to fundraise and accept donations? If one is appointed for a lifetime term, they are free from political considerations when making decisions, which is exactly what we need in the Judicial branch, decisions made without policical considerations coming into play.
